Following up on posts here and here, I submit a proposed constitutional amendment on pardons:
Proposed Pardon Reform Constitutional Amendment
Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several States within seven years after the date of its submission for ratification:
“Article —
“Section 1. Any pardon or commutation granted in the last 120 days of a President’s term of office shall not take effect until 30 days after the beginning the following term. The President, or the Vice President in cases subject to section 2 of this article, may revoke any pardon or commutation subject to this section prior to its effective date.
“Section 2. Where the subject of executive clemency is the President, the President’s spouse or child, or any other member of the President’s family as defined by Congress, the clemency power is vested in the Vice President rather than the President.”
